Court of Appeal disclosure judgment in Bank Mellat’s UK damages claim

We have reported previously on the ongoing case between Bank Mellat and HM Treasury. In 2013 the Supreme Court quashed the 2009 Order imposing sanctions on the bank.

Bank Mellat’s damages claim is going to trial in July 2019.  The Court of Appeal has now upheld the High Court’s order requiring the bank to disclose unredacted documents into a confidentiality ring, rejecting the bank’s argument that Iranian law prevents them from disclosing the documents.  See Bank Mellat v HM Treasury [2019] EWCA 449.
