EU court upholds Hamas 2015 designation

We reported in January 2019 on the EU cases upholding Hamas’ 2010 – 2014 listings, see previous post. The General Court has now held in Case T-289/14 that listing Hamas in 2015 was also lawful. This was because, in summary, although the US decisions on which the EU listing was based were insufficient for EU purposes because they did not give sufficient reasons, the UK Home Secretary’s decision was a sufficient legal basis, and satisfied the duty to give reasons and disclosed no error of factual assessment.
