David Vaughan CBE QC (1938-2018) – a sanctions pioneer

The sanctions world pays tribute to David Vaughan CBE QC, who passed away on Monday. He is well known for being the grandfather of European law in the UK (his cases read like an EU law textbook, including landmark constitutional cases such as Courage v Crehan and Factortame I and II). Less well known are his pioneering sanctions cases, in which his arguments on EU procedural justice paved the way for the jurisprudence that followed. David appeared for the People’s Mojehadin of Iran in the first EU case to establish procedural fairness in sanctions designations, and then in Kadi II, Tomana (Zimbabwe) and many others. David was instrumental in founding Brick Court Chambers and encouraged everyone from the most junior to the most senior with his kind, visionary and energetic style. He will be greatly missed.
